Terms of Service

1. Acceptance of terms

By creating an account or using My Living Memories (“the Platform”), you agree to these Terms of Service. If you do not agree, please do not use the Platform.

2. What the Platform is

My Living Memories is a private family memory platform. Creators preserve memories — stories, values, advice, blessings — and an AI avatar allows family members to interact with those memories in a conversational way.

3. What the Platform is not

• It is not a resurrection or replacement of a person.
• It is not a therapist, counsellor, or crisis service.
• It is not a source of medical, legal, or financial advice.
• The AI avatar responds only from creator-approved memories. It may make mistakes, miss context, or express things imperfectly.

4. Accounts and eligibility

• You must be at least 13 years old to create an account.
• Users under 18 must have parental or guardian consent and use guardian-enabled accounts.
• You are responsible for keeping your password secure.
• One person may hold one account. You may not create accounts for others without their knowledge.

5. Creator responsibilities

As a memory creator, you:

• Own and control all memories you upload.
• Are responsible for the accuracy and appropriateness of your content.
• Must not upload content that infringes on others' rights, is illegal, or is harmful.
• Grant us a limited licence to process, store, embed, and display your content solely for the purpose of operating the Platform.
• May revoke this licence at any time by deleting your content or account.

6. Family member responsibilities

As a family member, you:

• Access the Platform only through a valid invitation from a creator.
• Understand that avatar responses are AI-generated from the creator's approved memories and may not be perfectly accurate.
• Must not screenshot, record, or redistribute private conversations without the creator's permission.
• Must not attempt to manipulate the avatar into producing content outside the creator's intent.

7. AI avatar limitations

The AI avatar is a tool for memory preservation, not a sentient being. It can only draw from memories the creator has approved. It may occasionally misinterpret context, mix up details, or fail to answer. Safety filters intercept crisis language, requests for professional advice, and impersonation attempts.

We are not liable for emotional distress, decisions, or actions taken based on avatar conversations.

8. Legacy mode

Creators may designate a legacy contact who can activate the avatar after the creator is no longer able to manage their account. Legacy activation requires verification and is subject to a review process.

9. Prohibited use

You may not:

• Use the Platform to harass, impersonate, or harm others.
• Upload illegal, abusive, or infringing content.
• Attempt to reverse-engineer, scrape, or exploit the Platform.
• Circumvent safety filters or access controls.
• Use the Platform for any commercial purpose beyond its intended family use.

10. Subscriptions and billing

Some features require a paid subscription. Pricing, billing cycles, and plan limits are described on our pricing page. We reserve the right to change pricing with 30 days' notice. You may cancel at any time; access continues until the end of the billing period.

11. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Limitation of liability

The Platform is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

13. Changes to these terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use after changes constitutes acceptance.
